THE DEVELOPMENT OF GUIDELINES TO HELP LOCAL CORRECTIONS ADMINISTRATORS IN NEW HAMPSHIRE COMPLY WITH CONSTITUTIONAL STANDARDS AND AVOID LIABILITY IN COURT ACTIONS IS DESCRIBED, AND THE GUIDELINES ARE PRESENTED.
Abstract
LAWSUITS BROUGHT IN FEDERAL COURT AGAINST SOME OF NEW HAMPSHIRE'S COUNTY JAILS AND HOUSES OF CORRECTION MOTIVATED THE STATE CRIME COMMISSION TO ESTABLISH GUIDELINES THAT WOULD MAKE COURT INTERVENTION IN CORRECTIONS ADMINISTRATION UNNECESSARY. THE COMMISSION REVIEWED JUDICIAL AND LEGISLATIVE DIRECTIVES PERTAINING TO CORRECTIONS IN NEW HAMPSHIRE, ANALYZED FEDERAL CASE LAW REGARDING STATE AND LOCAL CORRECTIONS, REVIEWED APPLICABLE NEW HAMPSHIRE STATUTES, AND VISITED THE STATE'S 10 COUNTY CORRECTIONS FACILITIES AND JAILS TO DETERMINE AREAS IN WHICH GUIDELINES WERE NEEDED TO BRING LOCAL CORRECTIONS OPERATIONS IN LINE WITH LEGAL REQUIREMENTS. THE COOMMISSION'S GUIDELINES COVER CLASSIFICTION, MEDICAL SERVICES, RULES AND REGULATIONS, DISCIPLINE, FLOOR SPACE, VISITS, TELEPHONE PRIVILEGES, MAIL, OUTDOOR EXERCISE, INDOOR ACTIVITIES, LIBRARIES, ACCESS TOO COURTS, DIET, STAFF TRAINING, SANITATION, AND FIRE PREVENTION/CONTROL. THE COMMISSION ALSO DEVELOPED A CHECKLIST FOR USE BY LOCAL AUTHORITIES IN ASSESSING THE EXTENT TO WHICH THEIR CORRECTIONS FACILITIES MEASURE UP TO CONSTITUTIONAL STANDARDS. COPIES OF THE
