THIS BOOK IS DESIGNED TO ASSIST THE STUDENT OF CRIMINAL JUSTICE AND RELATED FIELDS IN UNDERSTANDING THE ROLE OF THE SUPREME COURT IN INTERPRETING THOSE PROVISIONS OF THE CONSTITUTION WHICH AFFECT CRIMINAL JUSTICE.
Abstract
UNITED STATES SUPREME COURT DECISIONS SINCE 1960 HAVE HAD A FAR-REACHING IMPACT UPON FEDERAL, STATE AND LOCAL CRIMINAL JUSTICE AGENCIES. IT ATTEMPTS TO PROVIDE AN UNDERSTANDING OF THE CONTENT OF IMPORTANT DECISIONS IN THIS AREA AS WELL AS THE REASONS GIVEN BY THE COURT FOR ITS DECISIONS. CONSTITUTIONAL LAW OPENS WITH A BRIEF HISTORY AND ANALYSIS OF THE CONSTITUTION, A SURVEY OF THE DEVELOPMENT AND IMPACT OF THE DOCTRINE OF JUDICIAL REVIEW AND A DESCRIPTION OF THE SUPREME COURT'S PROCESSING OF CRIMINAL JUSTICE CASES. THE ORIGIN AND EVOLUTION OF DUE PROCESS OF LAW AS A LIMITATION UPON CRIMINAL JUSTICE IS ANALYZED WITH SPECIAL EMPHASIS BEING GIVEN TO THE SCOPE OF THIS LIMITATION IN STATE CASES. IN-DEPTH COVERAGE IS GIVEN TO THREE SPECIFIC PROVISIONS OF THE BILL OF RIGHTS WHICH HAVE BEEN THE SUBJECT OF THE GREATER PART OF SUPREME COURT INTERPRETATION IN RECENT YEARS AS MORE SPECIFIC CONTOURS OF DUE PROCESS HAVE BEEN ELUCIDATED: THE RIGHT TO COUNSEL AT ALL 'CRITICAL STAGES' OF A PROSECUTION; THE PROTECTION AGAINST UNREASONABLE SEARCHES AND SEIZURES; AND THE PROTECTION AGAINST COMPULSORY SELFINCRIMINATION. ADDITIONAL PRE-TRIAL ISSUES SUCH AS ENTRAPMENT, BAIL, AND INDICTMENT BY GRAND JURY ARE DISCUSSED AND PROTECTIONS WHICH PROMOTE A FAIR TRIAL ARE COVERED IN DETAIL. ONE CHAPTER IS DEVOTED PRIMARILY TO THE 'DEATH PENALTY' DECISIONS, WITH EXCERPTS FROM THE OPINIONS OF EACH JUSTICE.
