This consumer protection manual is intended to inform New Mexicans of their rights as consumers under the State's consumer protection laws, while assisting businesses in complying with these laws.
Abstract
The organization of the Consumer and Economic Crimes Division of New Mexico's Attorney General's Office is described, including descriptions of the functions of the specialized units within the division. The manual also describes the policies and internal procedures of the division from the initial receipt of consumer complaints through to litigation. It discusses the following consumer protection statutes enforced by New Mexico's Attorney General; the New Mexico Unfair Practices Act, the False Advertising Act, the Pyramid or Multi-level Sales Act, the Indian Arts and Crafts Sales Act, the 1973 New Mexico Subdivision Act, the New Mexico Antitrust Act, and miscellaneous criminal statutes used for combating white-collar crime. Also described are intervention by the Attorney General before utility regulatory agencies and the Attorney General's authority to issue rules, regulations, opinions, and compliance guidelines. Other State and Federal agencies with consumer protection responsibilities are listed and briefly described. An organizational chart of the Consumer and Economic Crimes Division, a list of referral agencies, and a consumer complaint form are appended.
