Based primarily on U.S. Supreme Court and U.S. Circuit Courts of Appeal decisions, this reference book and text presents pertinent classical and current judicial decisions that define constitutional criminal procedure applicable to the daily activity of the professional law enforcement and criminal justice communities.
Abstract
Part I is intended as a college text on criminal procedure, criminal law, or general police science, as it explains the law of arrest, search and seizure, investigative detentions (stop and frisk), motor vehicle stops, and fire-scene procedures. The three chapters of Part II explore the legal issues associated with interviews, confessions and "Miranda," identification procedures, and the sixth amendment rights to counsel and confrontation of witnesses. Part III highlights the problems police officials face when they must establish an individual's possession of illegal drugs or possession with intent to distribute them. Part IV presents recent court cases pertinent to the nature of law- enforcement liability. Each of the principal cases presented consists of a court decision that has been analyzed, dissected, and restructured into a question-and-answer format. Table of cases and a subject index
