This volume, created exclusively for modern law enforcement and criminal justice practitioners operating in Federal and State systems, presents a new and innovative approach to the study of constitutional criminal procedures and provides a quick reference to pertinent classical and current judicial decisions.
Abstract
Most cases cited in the volume come from the U.S. Supreme Court and the U.S. Circuit Courts of Appeal. In addition, recognizing the proclivity of many State courts to depart from Federal rules and rely on their own State constitutions, many State court decisions are included in the volume. Each of the principal court cases consists of a court decision that has been analyzed, dissected, and restructured into a question and answer format. Criminal procedures and associated judicial decisions are organized according to four parts: (1) arrest, search, and seizure--search warrants, exceptions to the written warrant requirement, privacy and constitutional protection, non-governmental searches, regulatory and administrative searches, border searchers, fire scenes, investigative detentions, stop and frisk, the independent source doctrine, the inevitable discovery rule, and good faith and the exclusionary rule; (2) interviews and confessions, eyewitness identification, and sixth amendment rights to counsel and confrontation; (3) possession and distribution of drugs and other dangerous substances; and (4) liability. The final part of the volume includes the U.S. Constitution, a list of Supreme Court justices, a glossary of terms, and a table of cases.
