Five resolutions were drafted at a 1990 meeting of the United Nations Congress on the Prevention of Crime and the Treatment of Offenders that focus on police use of force, lawyers, criminal proceedings, prisoner transfer, and prosecutors.
Abstract
Each draft resolution contains basic principles and general provisions. The resolution on police use of force deals with policing unlawful assemblies, policing persons in custody or detention, police qualifications and training, and reporting and review procedures. The resolution on lawyers covers access to legal services, special criminal justice safeguards, and qualifications and duties of lawyers. The resolution on criminal proceedings focuses on bilateral and multilateral arrangements for the transfer of proceedings in criminal matters, while the resolution on prisoner transfer contains a model treaty for the transfer of offenders who have been conditionally sentenced or conditionally released. The resolution on prosecutors incorporates provisions on prosecutor qualifications and training, prosecutor services, the prosecutorial role in criminal proceedings, discretionary functions of prosecutors, and alternatives to prosecution.
