IN DESCRIBING THE MACHINERY WHICH OPERATES ON DEFENDANTS TO INDUCE THEM TO PLEAD GUILTY, THE AUTHOR ASSERTS THAT THEY ARE GIVEN A COMBINATION OF SOUND LEGAL ADVICE, INTIMIDATION, AND MISLEADING INFORMATION.
Abstract
A CASE STUDY IS PRESENTED OF A DEFENDANT WHO WAS INDUCED TO PLEAD GUILTY WHO HAD GONE THREE YEARS WITHOUT EVER SEEING A LAWYER. IN HIS DISCUSSION OF THE ANATOMY OF THE GUILTY PLEA INDUCEMENT, THE AUTHOR EXAMINES THE IMPORTANCE OF COP OUTS, THE AVAILABILITY OF BAIL VERSUS PRE-TRIAL DETENTION, CONDITIONS IN THE COUNTY JAIL, BARGAIN JUSTICE, THE FORMALITIES OF THE COP OUT, AND ITS FAIRNESS AND CONSTITUTIONALITY.
