THIS SOCIAL STUDIES COURSE OUTLINE FOR 12TH GRADE STUDENTS IS DESIGNED TO ENABLE STUDENTS TO DEVELOP CONCEPTS AND ATTITUDES CONCERNING THE CRIMINAL JUSTICE SYSTEM THROUGH EXAMINATION OF WISCONSIN AND CONSTITUTIONAL LAW.
Abstract
IT INTEGRATES SUCH SOCIAL STUDIES DISCIPLINES AS HISTORY, POLITICAL SCIENCE, SOCIOLOGY, AND ECONOMICS. THE CONCEPTS COVERED INCLUDE THE LEGISLATIVE PROCESS (JURISDICTION AND LEGISLATION), POLICE ASPECTS (LAW ENFORCEMENT AND DETECTION), COURT CONTROLS OF POLICE CONDUCT, THE STRUCTURE OF COURTS (DUAL JURISDICTION AND APPEAL), SEARCH AND SEIZURE (BURDEN OF PROOF AND SEARCH WARRANTS), CONFESSIONS, THE ROLES OF THE PROSECUTOR AND DEFENSE ATTORNEY, TRIAL PROCEDURE, AND SENTENCING. SUGGESTED QUESTIONS, ACTIVITIES, AND FURTHER REFERENCES ARE INCLUDED. VARIOUS TEACHING APPROACHES ARE SUGGESTED, SUCH AS SIMULATIONS AND ROLE PLAYING, LECTURES AND DISCUSSIONS, SMALL AND LARGE GROUP ACTIVITIES, AS WELL AS A WIDE RANGE OF AUDIOVISUAL MATERIALS. RECOMMENDATIONS ARE MADE FOR THE USE OF SUCH COMPONENTS AS COMMUNITY RESOURCES (LOCAL LAW ENFORCEMENT PERSONNEL) AND THE ACTIVE PARTICIPATION OF A LOCAL ATTORNEY TO FULFILL A TEACHING AND ADVISORY ROLE. APPENDIXES PROVIDE EXTENSIVE MATERIALS FOR USE IN THE CLASSROOM THAT RANGE FROM PRETESTS AND MOCK TRIALS TO AN EXAMPLE OF A SEARCH WARRANT AND THE FULL TEXT OF STATE V. MCDOUGAL. A CHART LISTS MAJOR COURSE CONCEPTS WITH EXAMPLES OF ISSUES AND PROCESSES THAT REVOLVE AROUND THEM.
