Australia's Crimes (Child Sex Tourism) Amendment Bill of 1994 changes the Crimes Act of 1914 by including a new part that identifies offenses involving Australian nationals and residents who engage in sexual relations with children overseas and individuals involved in the organization and promotion of child sex tourism.
Abstract
Part IIIA creates two specific offenses: (1) prescribed sex offenses committed overseas against children under 16 years of age; and (2) aggravated sex offenses committed overseas against children under 12 years of age. The bill also contains provisions on child consent, sex offense prosecution, the collection of evidence from overseas witnesses, and the conduct of trials. The bill defines the meaning of sexual intercourse and indecent acts, identifies persons who may be prosecuted for offenses committed overseas, and covers the issues of consent and resistance. In addition, the bill contains guidance on satellite video link evidence taken from persons overseas and the use of that evidence during trial. An article on the need to protect children from sexual abuse, an information sheet on child sex tourism, and the text of the Crimes (Child Sex Tourism) Amendment Act of 1994 are included.
