This manual provides a strategic and procedural guide for attorneys prosecuting or defending criminal anti-trust cases from indictment/information through notice of appeal.
Abstract
The manual covers four major areas. The first area provides a discussion of a miscellany of topics with which attorneys should be familiar prior to indictment. These include the basic antitrust statutes, form and content of information/indictment, arraignment pleas, the Speedy Trial Act, representation by counsel, and the uses of computers. The second area examines pretrial procedures for both prosecution and defense, including pretrial preparation, motions and requests, meetings and conference, and matters relating to the jury and witnesses. Next, special problems of criminal antitrust trials are elucidated, including problems of proof, conspiracy, witness immunity, use of prior statements, and other evidentiary and procedural matters. Finally, issues relating to the period after trial are considered. These include post-trial motions, duties of counsel, presentencing reports, types of sentences, the sentencing hearing, judgment, and appeals and other review. Appendixes include supplemental information, such as a summary of antitrust statutes and an index and digest of relevant court decisions. Approximately 350 references.
