This bulletin presents statistics and a narrative summary of criminal appeals against magistrates' sentences to the British Crown Court and against Crown Court sentences to the Court of Appeal (Criminal Division) in 1991 by result for appeals against conviction, appeals against sentence, and appeals against both conviction and sentence.
Abstract
The "rate of appeal" against magistrates' sentences in 1991 was estimated at about 0.7 percent and against Crown Court sentences at approximately 6 percent. Thus, over 99 percent of those found guilty at magistrates' courts and 94 percent of those found guilty at the Crown Court did not appeal. The success rate of appeals against sentence was 49 percent at the Crown Court and 26 percent at the Court of Appeal. In 1991, there were approximately 15,000 known appeals against magistrates' sentences to the Crown Court and just over 6,300 to the Court of Appeal against Crown Court sentence. The proportion of successful appellants to the Crown Court has increased from 25 percent in 1985 to 38 percent in 1991. In 1991, 13 percent of appellants to the Court of Appeal had their conviction quashed, a slight increase over the average for the previous four years. 14 tables and 6 notes
