THIS ARTICLE EXAMINES THE PROVISIONS, EVOLUTION, AND APPLICATIONS OF THE CRIMINAL JUSTICE ACT, WHICH PROVIDES FOR GOVERNMENT COMPENSATION FOR ATTORNEYS OF PERSONS FINANCIALLY UNABLE TO OBTAIN ADEQUATE REPRESENTATION.
Abstract
THE CRIMINAL JUSTICE ACT HAS BEEN IN FORCE SINCE 1964. THE ACT WAS INTENDED TO HANDLE THE INCREASING DEMAND FOR ATTORNEYS FOR THOSE WHO COULD NOT AFFORD TO PAY FOR SUCH SERVICES. THE ORIGINAL PROVISIONS OF THE ACT AND THE AMENDMENTS INCORPORATED IN 1970 ARE OUTLINED. AMONG THE PROVISIONS DISCUSSED ARE THOSE DEALING WITH ADMINISTRATION OF THE ACT, APPOINTMENT OF ATTORNEYS, PAYMENT OF ATTORNEYS, COMPENSATION IN EXCESS OF THE STATUTORY MAXIMA, AND PROVISION OF INVESTIGATIVE, EXPERT, AND OTHER SERVICES....DMC
