THE ADMINISTRATION OF CRIMINAL JUSTICE IN POST-WORLD WAR II JAPAN IS OUTLINED, INCLUDING LAW ENFORCEMENT, TRIAL PROCEDURES, CORRECTIONS, AND LEGAL SERVICES.
Abstract
THE STRUCTURE OF JAPAN'S POLICE SYSTEM IS BRIEFLY DESCRIBED, INCLUDING THE ORGANIZATION AND FUNCTIONS OF ITS THREE PRINCIPAL DIVISIONS: THE NATIONAL PUBLIC SAFETY COMMISSION; THE NATIONAL POLICE AGENCY; AND THE PREFECTURAL POLICE. POLICE FUNCTIONS, THEIR DUTY IN CRIMINAL INVESTIGATION, CRIME TRENDS IN JAPAN, AND SPECIAL PROCEDURES FOLLOWED BY POLICE IN JUVENILE CASES ARE CONSIDERED. CRIMINAL PROCEDURE FROM ARREST TO TRIAL IS TRACED -- THE ISSUANCE OF ARREST WARRANTS, ARRAIGNMENT, PROCEDURES FOR TRAFFIC OFFENSES, AND RIGHTS OF THE DEFENDANT. TRIAL COURTS, RULES OF EVIDENCE, SENTENCING, APPEAL PROVISIONS, PROBATION AND PAROLE, AND JUVENILE LAW ARE DISCUSSED. THOSE ASPECTS OF THE SYSTEM WHICH ARE DIFFERENT FROM ANGLO-AMERICAN LAW, SUCH AS THE PROVISION OF COMPENSATION FOR DEFENDANTS FOUND INNOCENT, ARE EMPHASIZED. AN EVALUATION OF THE CORRECTIONAL SYSTEM INCLUDES A PROFILE OF JAPAN'S PRISON POPULATION; ITS CLASSIFICATION SYSTEM FOR CUSTODIAL PURPOSES; VARIOUS TYPES OF INSTITUTIONS; EDUCATION, RECREATION, AND REHABILITATION PROGRAMS; INMATE DISCIPLINE; AND THE TREATMENT OF INMATES IN JUVENILE TRAINING SCHOOLS. A BRIEF DISCUSSION OF THE JAPANESE LEGAL PROFESSION, ITS BAR ASSOCIATIONS, AND LEGAL TRAINING IS INCLUDED. (VDA)
