THIS ARTICLE PRESENTS A SKETCH OF THE MAJOR ELEMENTS AND OPERATION OF THE SCOTTISH CRIMINAL JUSTICE SYSTEM TOGETHER WITH SOME COMPARATIVE AND EVALUATIVE ANALYSIS.
Abstract
THE AREAS CONSIDERED INCLUDE THE PERSONNEL OF THE SCOTTISH CRIMINAL JUSTICE SYSTEM, SYSTEM STRUCTURE, PROCEDURE FOR APPELLATE REVIEW TO THE HIGH COURT, AND THE RULE OF CORROBORATION. ALSO DISCUSSED ARE THE NATURE OF CRIME IN SCOTLAND AND DIFFERENCES BETWEEN THE SCOTTISH AND UNITED STATES CRIMINAL JUSTICE SYSTEMS. IDENTIFIED AS CHARACTERISTIC ELEMENTS OF THE SCOTTISH SYSTEM ARE A LIMITED RIGHT TO A JURY TRIAL, A PROFESSIONAL CORPS OF CAREER PROSECUTORS, JURY VERDICTS BASED ON A MAJORITY VOTE, AND THE ABSENCE OF OPENING STATEMENTS BY EITHER THE PROSECUTION OR THE DEFENSE.
