THIS ARTICLE FOCUSES ON THE APPLICABILITY OF THE FEDERAL CRIMINAL CODE, TITLE 18 OF THE UNITED STATES CODE, TO POTENTIAL CRIMINAL ABUSES OF COMPUTER SOFTWARE.
Abstract
A BRIEF INTRODUCTION DISCUSSES THE STRUCTURE AND JURISDICTIONAL BASES OF THE CODE AND THE STATUS OF PROPOSED REVISIONS. THE RELATION OF THE FEDERAL CRIMINAL CODE TO STATE CRIMINAL CODES IS THEN DISCUSSED, SPECIFICALLY WITH REGARD TO ASSIMILATED CRIMES (THOSE STATE-DEFINED OFFENSES COMMITTED IN FEDERAL ENCLAVES WHICH MAY BE PROSECUTED FEDERALLY) AND MULTIPLE JURISDICTIONS. APPROXIMATELY 40 FEDERAL CRIMES WHICH MAY BE APPLICABLE TO COMPUTER ABUSE ARE ALSO ANALYZED. THEY ARE GROUPED INTO SEVEN BROAD CATEGORIES - THEFT AND RELATED OFFENSES, ABUSE OF FEDERAL CHANNELS OF COMMUNICATION, NATIONAL SECURITY OFFENSES, TRESPASS AND BURGLARY, DECEPTIVE PRACTICES, MALICIOUS MISCHIEF AND RELATED OFFENSES, AND MISCELLANEOUS.
