Abstract
THE AUTHOR CONSIDERS CRIMINAL RESPONSIBILITY OF THE DEFENDANT IN TERMS OF BOTH THE OLDER CONCEPT WHEREBY THE DEFENDANT WOULD INCUR CRIMINAL RESPONSIBILITY FOR ANY MURDER COMMITTED DURING THE COURSE OF A FELONY AND THE RECENTLY ADOPTED CONCEPT OF CRIMINAL RESPONSIBILITY FOR MURDER WHEN THERE IS AN INTENTIONAL ACT DONE WITH A KNOWING DISREGARD FOR LIFE. THE OLDER CONCEPT IS KNOWN AS FELONY MURDER. THE NEW CONCEPT IS BASED ON VICARIOUS LIABILITY. THIS ARTICLE IS STRICTLY LIMITED TO THE LAWS OF CALIFORNIA.
