QUICK REFERENCE COMMENTARY PROVIDING A TERM-BY-TERM, CASE-BY-CASE REVIEW OF ALL SUPREME COURT CRIMINAL LAW RULINGS HANDED DOWN IN THE PAST 15 YEARS CHRONICLING AN INDIVIDUAL RIGHTS REVOLUTION AND ITS AFTERMATH.
Abstract
THE REVOLUTION IS TRACED FROM THE 1960-61 TERM RULING IN MAPP V OHIO TO THE 1968-69 TERM DECISION IN BENTON V. MARYLAND DURING NINE TERMS OF THE WARREN COURT IN WHICH THE FOURTEENTH AMENDMENT WAS USED TO MAKE FOURTH, FIFTH, AND SIXTH AMENDMENT GUARANTEES BINDING UPON THE STATES. THE AFTERMATH ENCOMPASSES THE FIRST SIX TERMS OF THE BERGER COURT WHICH HAVE SEEN CONSOLIDATION OF SOME OF THE RIGHTS OF DEFENDANTS DELINEATED BY THE WARREN COURTS AND RETRENCHMENT OF OTHERS. OVER 500 CASES ARE SUMMARIZED UNDER MORE THAN 50 HEADINGS. EACH CASE IS ANALYZED, DRAWING ATTENTION TO EARLIER CASES OVERRULED OR DISTINGUISHED AND TO THE VIEWS OF DISSENTING JUSTICES. THE LANDMARK CASES ARE PLACED IN THE HISTORICAL CONTEXT OF THE JUDICIAL STRUGGLE TO INSURE THE RIGHTS OF CRIMINAL SUSPECTS THAT BEGAN OVER 30 YEARS AGO.
