This book summarizes the basic principles of Canadian criminal law.
Abstract
Chapter 1 contains a survey of constitutional law as it effects the entire criminal process including the enactment of offenses, investigation of crime, the criminal trial process, presumption of innocence, and sentencing. Chapter 2, The Prohibited Act or Actus Reus, reviews codification of the criminal act and the role of the actus reus in criminal liability. Chapter 3 reviews unfulfilled crimes and participation in crimes (attempts, conspiracy, counseling a crime that is/is not committed, aiding and abetting, intention to commit an unlawful purpose, and accessory after the fact). Chapter 4 examines the fault element, or mens rea. Chapter 5 discusses regulatory offenses and corporate crime. Chapters 6 through 8 review defenses that may prevent conviction: intoxication, mental disorder, automatism, provocation, self-defense, necessity, and duress. Chapter 9 examines sentencing--principles and purposes of sentencing, aggravating and mitigating factors, constitutional considerations, and sentences other than imprisonment. Chapter 10 describes models of the criminal justice system, trends in criminal law and perspectives on the basic principles, and jurisprudence examined in the book.
