This 1993 Supplement to the fourth edition of Criminal Procedure Cases and Comments (see NCJ-137086) presents notes and additional court cases for sections of the main report that address limitations on police practices and procedures and the judicial process.
Abstract
Six chapters address limitations on law enforcement practices and procedures. The chapter on confessions and interrogations presents material on the voluntariness of confessions, the requirements of Miranda v. Arizona, the interrogation of suspects after the initiation of formal proceedings, and other fifth amendment issues. The chapter on eyewitness identification procedures contains supplementary material on suggestiveness in identification procedures. A chapter on wiretapping and electronic surveillance contains supplementary material on nonconsensual wiretapping and electronic surveillance. Remaining chapters on police legal limitations address the limits of undercover work and exclusionary principles and alternative remedies for unlawful investigative practices. Eleven chapters pertain to the judicial process. Five of the chapters contain supplementary material on grand jury proceedings, pretrial motions, competency to stand trial, disclosure and discovery, and pleas. The remaining six chapters present supplementary notes and cases on trial by jury, the quality of representation by counsel, the problems encountered in presenting a case, submitting the case to the jury, sentencing, and appellate and other posttrial remedies.
