COMPREHENSIVE OUTLINE OF PROCEDURES, COURTS, AND AUTHORITIES RESPONSIBLE FOR ENFORCING THE CRIMINAL LAW BY A SCOTTISH PUBLIC PROSECUTOR.
Abstract
EMPHASIS IS LAID ON HOW DECISIONS ARE MADE PRIOR TO THE CASE COMING TO TRIAL AND HOW THE VERDICTS ARE REACHED IN THE COURTS. ALSO DESCRIBED ARE PRE-TRIAL INVESTIGATION AND THE PREPARATION FOR COURT OF CRIMINAL CASES. INCLUDED IS AN EXPLANATION OF HOW CIVIL CLAIMS FOR DAMAGES IN FRANCE ARE PURSUED IN THE CRIMINAL COURTS. NUMEROUS PRACTICAL EXAMPLES ARE PROVIDED THROUGHOUT THE BOOK. IT MAY BE ADDED THAT SCOTLAND HAS ITS OWN LEGAL SYSTEM COMPLETELY INDEPENDENT FROM THAT PRACTICED IN ENGLAND AND DIFFERING WIDELY FROM THE LATTER. SINCE THE EIGHTEENTH CENTURY, SCOTS LAW HAS BEEN INFLUENCED BY ENGLISH LEGAL THOUGHT AND TRADITION, BUT SCOTLAND HAS LONG HISTORICAL ASSOCIATIONS WITH FRANCE THAT ARE EVIDENCED IN SCOTS LAW.
