Abstract
THE IMPORTANCE OF CONSTITUTIONAL CONTROLS ON THE ACQUISITION AND PROCEDURAL USE OF EVIDENCE IS STRESSED, AS ARE THE CONSTITUTIONAL DOCTRINES WHICH UNDERLIE FORMAL CRIMINAL PROCEEDINGS. INCLUDED IS THE RELEVANT TEXT OR AN EDITORIAL SUMMARY OF THE IMPORTANT UNITED STATES SUPREME COURT DECISIONS IN EACH PROBLEM AREA, AND A TEXTUAL SUMMARY OF THE ENSUING APPLICATION OF THOSE DECISIONS IN THE STATE AND LOWER FEDERAL COURTS. THE STATUTORY PROVISIONS REGULATING CRIMINAL PROCEDURE ARE ILLUSTRATED BY EXCERPTS FROM THE FEDERAL RULES AND FROM NEW YORK AND LOUISIANA STATUTES. REFERENCE IS ALSO MADE TO THE AMERICAN BAR ASSOCIATION STANDARDS FOR THE ADMINISTRATION OF JUSTICE. (AUTHOR ABSTRACT MODIFIED.)
