This text provides an overview of criminal process in the areas of investigation and prosecution through an examination of Federal law and practice.
Abstract
Individual chapters provide citations to applicable Federal Rules of Criminal Procedure, case summaries, and commentaries. Part 1 examines all the components of investigation, including search, seizure, stop (and frisk), arrest, examination and identification, questioning, and warrant versus warrantless actions. Also covered are lineups; immunity from prosecution; and the use of informers, eavesdropping, and wiretaps. Chapters on prosecution examine legal issues arising from the time of preliminary examination through trial and appeal. Individual chapters cover bail, the decision to prosecute, indictment, pleas and plea bargaining, and pretrial proceedings (e.g., joinder, continuance, and discovery). Trial procedures dealt with include voir dire, prosecution and defense, witnesses, motions, instructions, and verdict. Sentence and judgment and appeal procedures also are considered, as are double jeopardy and collateral estoppel and attack. Table of cases, index, and chapter footnotes.
