SYSTEMS OF SHORT-TERM INCARCERATION WITH THE PURPOSE OF GIVING THE JUVENILE OFFENDER A LIMITED UNPLEASANT EXPERIENCE IN ORDER TO KEEP THEM OUT OF PRISON BUT STILL DISSUADE THEM FROM FURTHER OFFENSES.
Abstract
THE GERMAN YOUTH ARREST AS COMPARED TO THE ENGLISH DETENTION CENTRES IS THE MUCH MORE DELIBERATE EFFORT TO PUT INTO EFFECT A PHILOSOPHY OF INDIVIDUAL DETERRENCE, AS APPLIED TO YOUNG DELINQUENTS WHO ARE NOT IN NEED OF ANYTHING MORE (OR LESS) THAN JUST SUCH AN EXPERIENCE. AS BOTH MEASURES COMPARED ARE EXPERIMENTS IN SHORT TERM IMPRISONMENT SHOULD HAVE BECOME MUCH MORE MANIFEST IN THE GERMAN THAN IN THE ENGLISH WAY OF HANDLING THE PROBLEM IN PRACTICE. IN BOTH COUNTRIES, MOREOVER, THERE ARE INCREASING DOUBTS AS TO THE FUNDAMENTAL PREMISE FOR THIS WAY OF HANDLING THE PROBLEM. (AUTHOR ABSTRACT)
