This material for the Massachusetts Attorney General's training conference on "Current Issues in Campus Law Enforcement" focuses on the interrelationship between college disciplinary procedures and law enforcement.
Abstract
The material is designed to provide conference participants with the legal guidance required to deal effectively with incidents of drug and alcohol abuse, hate crimes, and date rape. The first section documents campus police powers and responsibilities as specified in Massachusetts law, followed by a case scenario that illustrates the proper interrelationship between campus disciplinary proceedings and the prosecution of a criminal case. Workshop materials focus on six issues: hate crimes and police liability, domestic violence and sexual assault, the use and abuse of drugs and alcohol, access to records, campus disciplinary procedures, and discipline for off- campus acts. Each of these sections presents Massachusetts law and authoritative policy statements that relate to campus police actions in addressing various offenses. Material pertinent to disciplinary procedures for off-campus acts consists of the Maryland opinion of the Attorney General on off-campus misconduct.
