REVIEW OF THE CURRENT STATE OF JUVENILE COURT CASE LAW AND STATUTES, WITH DISCUSSION OF THE PHILOSOPHY OF THE JUVENILE COURT AND THE ROLE OF LAW ENFORCEMENT AGENTS.
Abstract
THIS REVIEW OF JUVENILE COURT CASE LAW AND STATUTES IS INTENDED AS A SYSTEMATIC SUMMARY FOR THOSE WORKING WITHIN THE JUVENILE JUSTICE SYSTEM - POLICE, JUVENILE COURT OFFICERS, PROBATION OFFICERS AND CORRECTIONS STAFF. THE CENTRAL FOUR CHAPTERS DEAL WITH THE JUVENILE COURT PROCESS IN DETAIL FROM THE TAKING OF THE CHILD INTO CUSTODY THROUGH AFTERCARE, DEALING WITH THE ROLE OF LAW ENFORCEMENT AGENTS, INTAKE AND ADJUSTMENT, THE HEARING PROCESS, AND DISPOSITION ALTERNATIVES. SPECIFIC LEGAL QUESTIONS THAT MUST BE FACED BY JUVENILE OFFICERS IN POLICE, PROBATION, AND COURT DEPARTMENTS, ARE STATED. CITATIONS ARE GIVEN TO THE MAJOR CASES IN LEADING JURISDICTIONS, TO TYPICAL STATE STATUTES, TO UNIFORM ACTS AND OTHER PENDING PROPOSALS, AND TO HELPFUL ARTICLES AND TREATISES. THE TEXT ATTEMPTS TO REPORT THE CURRENT STATUS OF THE LEGAL POINTS, AS WELL AS TO ASSESS THE TREND OF LAW. ONE CHAPTER DEALS WITH THE SUBSTANTIVE LAW OF JUVENILE COURTS - CRIMINAL AND NON-CRIMINAL CONDUCT, AND NEGLECT AND DEPENDENCY. OPENING AND CLOSING CHAPTERS SET OUT THE MAJOR COMPETTING MODELS OF THOUGHT UNDERLYING THE JUVENILE JUSTICE SYSTEM AND LIKELY STATUTORY AND CONSTITUTIONAL DEVELOPMENTS. (AUTHOR ABSTRACT)
