THIS ESSAY EXAMINES THE TENDENCY IN ENGLAND AND WALES, AS IN OTHER COUNTIRES, FOR CUSTODIAL TREATMENT TO DEVELOP FORMS WHICH ARE LESS CUSTODIAL AND WHICH GRADUALLY COME TO RESEMBLE FORMS OF TREATMENT IN THE COMMUNITY.
Abstract
THE TREATMENT FORMS DISCUSSED INCLUDE OPEN INSTITUTIONS, OUTSIDE WORKING PARTIES, HOME LEAVES, PRE-RELEASE EMPLOYMENT SCHEMES, INTERMITTENT CUSTODY, AND CONJUGAL VISITS; IT IS SUGGESTED THAT SUCH CUSTODIAL ALTERNATIVES IN REALITY INVOLVE A GREATER LOSS OF FREEDOM THAN DO TRUE COMMUNITY BASED TREATMENT FORMS. RECOMMENDATIONS INCLUDE CONTINUANCE OF THE TREND TOWARD FEWER AND FEWER CUSTODIAL SENTENCES AND RELEASE OF ALL PRISONERS CONVICTED OF MINOR OFFENSES AFTER A THIRD OF THEIR SENTENCE HAS BEEN SERVED. REFERENCES ARE PROVIDED.
