THIS 1979 COURSE HANDBOOK FOR DEFENSE ATTORNEYS EXAMINES TRENDS IN CRIMINAL LAW AND CRIMINAL CASES.
Abstract
IN 1979, THE U.S. SUPREME COURT RULED ON CASES INVOLVING PROBABLE CAUSE, SEARCH AND SEIZURE, ELECTRONIC SURVEILLANCE, JURIES, RIGHT TO JURY OR COUNSEL, AND PRISONERS' RIGHTS. DISCUSSIONS OF THESE CASES AND JUDICIAL OPINIONS ARE INCLUDED. DISCUSSION OF THE FOURTH AMENDMENT COVERS PROBABLE CAUSE, RIGHT TO PRIVACY, EVIDENCE ADMISSIBILITY, AND ARREST, INCLUDING SIGNIFICANT CASES. DISCUSSION OF PROSECUTORIAL DISCRETION REVIEWS JUDICIAL LIMITS IMPOSED UPON IT IN CALIFORNIA AND COURTS' INCREASING WILLINGNESS TO BRING CHARGES AGAINST DEFENDANTS IN ADDITION TO PROSECUTION CHARGES. BASIC THEORIES OF EVIDENCE ADMISSIBILITY ARE EXAMINED FOR DEFENSE ATTORNEYS, FOLLOWED BY AN EXAMINATION OF THE CONSTITUTIONALITY OF INTRODUCING LABORATORY REPORTS AGAINST CRIMINAL DEFENDANTS. PRETRIAL MATTERS INCLUDE PREPARING WITNESSES FOR GRAND JURIES AND OTHER PROBLEMS ATTORNEYS FACE WHEN DEALING WITH GRAND JURIES. GOVERNMENT INVESTIGATIONS, CRIMINAL MOTION PRACTICES, AND DISCOVERY ARE ALSO DISCUSSED. TRIAL TOPICS INCLUDE DEMONSTRATIVE EVIDENCE AND TRIAL TACTICS, A SCIENTIFIC EVIDENCE UPDATE, STUDIES OF EYEWITNESS IDENTIFICATION, AND HYPNOSIS. REPORTS ON CREATIVE DEFENSES COVER VARIOUS PSYCHIATRIC ISSUES. FINAL TOPICS ARE SELF-DEFENSE, CRIMINAL DISCOVERY OF CITIZEN COMPLAINTS AGAINST THE POLICE, AND THE ECONOMICS OF CRIMINAL LAW. FOOTNOTES, A SEMINAR PROGRAM SCHEDULE, AND A FACULTY LIST ARE INCLUDED. (PAP)
