REVIEW OF THE PROCEDURAL RIGHTS AND POWERS OF THE DEFENSE COUNSEL AS THEY ARE PROVIDED FOR IN THE WEST GERMAN CODE OF CRIMINAL PROCEDURE SINCE A REVISION OF THE CODE IN 1964.
Abstract
THE ASSESSMENT IS MADE IN THE LIGHT OF A GROWING NUMBER OF CRIMINAL CASES RESULTING FROM A RECENT SERIES OF GUARANTEES OF THE LEGAL RIGHTS OF THE ACCUSED. ANOTHER DEVELOPMENT WHICH HAS INCREASED INTEREST IN THE ROLE OF THE DEFENSE COUNSEL IS A SERIES OF CASES INVOLVING CONTROVERSIAL POLITICAL AND SOCIAL OPINIONS WHICH WERE ADVOCATED BY COUNSEL AS WELL AS THE DEFENDANTS. THERE HAS ALSO BEEN A CONSIDERABLE TRANSFER OF THE DEFENSE COUNSEL'S WORK FROM THE TRI TO THE PRELIMINARY INQUIRY PRIOR TO ACCUSATION (ERMITTLUNGSVERFAHREN). PART 2 IS NCJ-18408. --IN GERMAN
