This document contains a set of guidelines for use in the Defense Procurement Fraud Debarment Program.
Abstract
The Fraud Debarment Program was developed as part of the National Defense Authorization Act of 1993 and is administered by the Office of Justice Programs (OJP) in the Bureau of Justice Assistance (BJA). The program aims to prevent "any individual convicted of fraud or any other felony arising out of a contract with the Department of Defense" from serving in a management or supervisory capacity on any defense contract, on the board of directors of any defense contractor or subcontractor, as a consultant or representative of a defense contractor or subcontractor, or in any capacity to influence or control the decisions of the defense contractor or subcontractor. These guidelines specify the length of the prohibition period, exclusions from debarment, and the criminal penalties that may be applied to those contractors that knowingly hire someone who has been debarred. Additional issues addressed in the guidelines include an information clearinghouse that will contain information on those individuals convicted of defense related fraud or felony, statements from individuals who meet the disqualification requirements of the Program, deficient statement filings, supplemental statement filings, filing of statements, acknowledgement of statements, privacy act matters, processing of statements to the General Services Administration, release of information concerning statement and inquiries concerning application of the act, and appeal of debarment.
