BASIC CONSIDERATIONS AND GENERAL GUIDELINES FOR PREPARING A REQUEST FOR PROPOSALS FOR CONTRACTING SERVICES FOR STATUS OFFENDERS ARE DISCUSSED, AND A SAMPLE REQUEST FOR PROPOSALS AND A SAMPLE CONTRACT ARE PROVIDED.
Abstract
IN FULFILLING THE THRUST OF THE JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT OF 1974 REGARDING ITS ENCOURAGEMENT OF COMMUNITY-BASED ALTERNATIVES TO TRADITIONAL DETENTION AND CORRECTIONAL FACILITIES FOR STATUS OFFENDERS, STATE AND LOCAL AGENCIES WILL BE UNABLE TO PROVIDE ALL THE SERVICES NEEDED BY THESE YOUTH. MANY NECESSARY SERVICES WILL HAVE TO BE PURCHASED. THE PROCESS OF SOLICITING SUCH SERVICES BY A REQUEST FOR PROPOSALS (RFP) AND CONTRACT AWARD IS DISCUSSED HERE. WHETHER THE AGENCY DECIDES TO PURCHASE THE REQUIRED SERVICES THROUGH COMPETITIVE GRANTS OR CONTRACTS, IT IS NECESSARY TO PREPARE A FORMAL DOCUMENT SOLICITING THE PROPOSALS FOR THE REQUIRED SERVICES. IN THE CASE OF CONTRACTS, A RFP IS PUBLISHED WHICH SETS FORTH THE REQUIREMENTS AND OBJECTIVES TO BE MET BY THE PROPOSING AGENCY. GENERALLY, A RFP WILL CONSIST OF FIVE SECTIONS WHICH CONTAIN GENERAL INFORMATION, A STATEMENT OF WORK, INFORMATION REQUIRED FROM BIDDERS, PROPOSAL SELECTION CRITERIA, AND VARIOUS ATTACHMENTS. THE CONTENT OF EACH SECTION, AS WELL AS ITS COMPONENT PARAGRAPHS AND THE REASONS FOR INCLUDING THEM, ARE DISCUSSED. AFTER A POTENTIAL CONTRACTOR HAS BEEN SELECTED ON THE BASIS OF RESPONSE TO THE RFP, THE NEXT PHASE IS TO GUARANTEE THAT SERVICE WILL BE PROVIDED AS INTENDED, AND THAT THE SERVICE PROVIDER WILL BE PROPERLY REIMBURSED. THE CONTRACT BECOMES THE FINAL LEGAL DEFINITION OF AGREEMENT BETWEEN THE AGENCY AND THE SERVICE PROVIDER. A SAMPLE CONTRACT IS PROVIDED WHICH IS INTENDED TO PERMIT APPLICATION TO A BROAD ARRAY OF SITUATIONS. FREQUENTLY, ALTERNATIVE CLAUSES ARE PROVIDED. (RCB)
