This study examined the use of immigration powers when dealing with foreign national (FN) arrestees and whether this could be expanded and improved.
Abstract
This study reports on the findings of a pilot study introduced in four areas to assess the efficacy of enhanced checks to determine immigration and nationality status. It also examines the effect of these enhanced checks on local frontline policing and in particular on practices within police custody suites. The most central findings relate to the practical difficulties and potential complexities involved in establishing an individual's identity, nationality and migrant status, even in circumstances where adequate resources and skilled officials are available. The pilots provided ample evidence to show that even with a modest increase in scrutiny, there was a substantial pay-off in terms of law enforcement and UK Border Agency outcomes. The police and the UK Border Agency have already implemented a range of actions designed to improve the practices involved in checking the nationality and migrant status of arrestees since the 2006 - 2007 fieldwork that provided data for this study; estimates produced throughout this report should be treated with some degree of caution and are best viewed as indicative.
