A STUDY TESTING THE DETERRENCE HYPOTHESIS AS IT APPLIES TO THE OFFENSE OF DRAFT EVASION BY STATISTICALLY ANALYZING STATE-BY-STATE DATA FROM THE POST-LOTTERY PERIOD.
Abstract
CONCLUSIONS INCLUDE THAT A SIGNIFICANT NEGATIVE ASSOCIATION HAS BEEN FOUND BETWEEN THE PROBABILITY OF CONVICTION AND THE DRAFT EVASION RATE. RESULTS ALSO INDICATE THAT THE STIGMA OF CONVICTION IS THE DOMINANT FACTOR IN THE ASSOCIATION BETWEEN DRAFT EVASION RATES AND THE PROBABILITY OF PUNISHMENT, A VIEW CONSISTENT WITH THE CONTENTION THAT THE CERTAINTY OF PUNISHMENT HAS A STRONGER EFFECT ON CRIME THAN THE SEVERITY OF PUNISHMENT.
