THIS HANDBOOK ACCOMPANIES A 3-DAY WORKSHOP WHICH GIVES SENTENCING GUIDELINES AS AN AID IN MAKING SENTENCING DECISIONS THAT RETAIN JUDICIAL DISCRETION.
Abstract
THIS WORKSHOP IS PART OF AN OVERALL TRAINING PROGRAM SPONSORED BY THE NATIONAL INSTITUTE OF LAW ENFORCEMENT AND CRIMINAL JUSTICE. FOLLOWING AN INTRODUCTORY SECTION, WHICH PROVIDES AN OVERVIEW OF THE EXECUTIVE TRAINING PROGRAM IN ADVANCED CRIMINAL JUSTICE PRACTICES AND THE STRATEGY INVOLVED IN DEVELOPING SENTENCING GUIDELINES, GOALS, AND OBJECTIVES, THE HANDBOOK FOLLOWS THE WORKSHOP SESSION BY SESSION. A RATIONALE AND GOAL IS DETAILED FOR EACH SESSION. CASE STUDIES, BACKGROUND INFORMATION, AND OTHER MATERIALS RELEVANT TO THE TOPIC ARE ALSO INCLUDED. THE SESSIONS COVER: AN OVERVIEW OF SENTENCING GUIDELINES; SENTENCING PROBLEMS; THREE SENTENCING CASE STUDIES PLUS AN OVERVIEW AND SUMMARY OF THE CASE STUDIES; USING SENTENCING GUIDELINES; TYPES OF GUIDELINES; ONE JUDGE'S SENTENCING EXPERIENCE; ESTABLISHING SENTENCING GUIDELINES; AN ACTION PLAN; AND IMPLEMENTING INNOVATION. AN APPENDED PAPER ON IMPLEMENTING INNOVATION SURVEYS THE TECHNICAL AND HUMAN FACTORS WHICH HINDER THE INTRODUCTION OF NEW IDEAS AND PRESENTS TECHNIQUES FOR OVERCOMING THESE OBSTACLES. OTHER APPENDIXES PRESENT A BIBLIOGRAPHY, AN ARTICLE TITLED 'IS THE END OF JUDICIAL SENTENCING IN SIGHT?,' AN EDITORIAL ON SENTENCING DISPARITY, A GLOSSARY OF TERMS, CASE STUDY AIDS, AND A PROPOSAL OUTLINE FOR SENTENCING GUIDELINES.
