THE HISTORY AND DEVELOPMENT OF WISCONSIN STATUTORY AND CASE LAW PERTAINING TO JUVENILES ARE EXAMINED, AND THE IMPACT ON U.S. SUPREME COURT DECISIONS ON THE WISCONSIN JUVENILE JUSTICE SYSTEM IS EXPLORED.
Abstract
THE HISTORY OF WISCONSIN JUVENILE CODES IS TRACED FROM THE ESTABLISHMENT OF THE FIRST JUVENILE COURT IN 1901 TO THE PRESENT. A WIDE RANGE OF JUVENILE JUSTICE ISSUES BAIL, RIGHT TO COUNSEL, DUE PROCESS, JURY TRIALS FOR JUVENILES, WAIVER OF RIGHTS, AND PROBABLE CAUSE HEARINGS - ARE EXAMINED IN THE CONTEXT OF WISCONSIN LAW AND U.S. SUPREME COURT DECISIONS. THE AUTHOR ARGUES, IN VIEW OF THE MANY REFORMS IN JUVENILE JUSTICE, THAT A NEW APPROACH SHOULD PERHAPS BE CONSIDERED - ONE WHICH WILL GIVE NEW EMPHASIS TO DISCIPLINE AND THE RIGHTS OF LAW-ABIDING CITIZENS.
