PROCEEDINGS ARE DESCRIBED FROM A CONFERENCE DESIGNED TO IDENTIFY THE CRUCIAL ISSUES, INTERESTS, CAPABILITIES, BARRIERS, AND OBJECTIVES RELEVANT TO THE DEVLOPMENT OF A NATIONAL WHITE-COLLAR CRIME ENFORCEMENT STRATEGY.
Abstract
THE CONFERENCE WAS ATTENDED BY LOCAL PROSECUTORS AND REPRESENTATIVES OF THE FEDERAL BUREAU OF INVESTIGATION, FBI THE SECURITIES AND EXCHANGE COMMISSION, THE DEPARTMENT OF JUSTICE, LEAA, THE AMERICAN BAR ASSOCIATION, AND VARIOUS REPRESENTATIVES FROM ACADEMIA, RESEARCH INSTITUTES, A CONGRESSIONAL SUBCOMMITTEE, THE JUDICIARY, AND THE PRIVATE SECTOR. THE FOCUS OF THE DISCUSSION WAS UPON THREE PAPERS COMMISSIONED FOR THE CONFERENCE. THE FIRST CONFERENCE SESSION RESPONDED TO A PAPER PRESENTED ON WHITE-COLLAR CRIME AS FRAUD, ABUSES OF ORGANIZATIONAL POSITION, AND ORGANIZATIONAL MALFEASANCE. ALTERNATIVE CONCEPTUALIZATIONS OF WHITE-COLLAR CRIME AND THE IMPLICATIONS FOR INSTITUTIONS AND INSTITUTIONAL ARRANGEMENTS WERE CONSIDERED IN THIS SESSION. BARRIERS TO AND THE POTENTIAL FOR COOPERATION BETWEEN INSTITUTIONS VULNERABLE TO WHITE-COLLAR CRIME AND THE CRIMINAL JUSTICE SYSTEM WERE EXAMINED SO AS TO IDENTIFY KEY ELEMENTS NEEDED FOR A WHITE-COLLAR CRIME CONTAINMENT EFFORT. A SECOND CONFERENCE SESSION RESPONDED TO A PAPER ON THE CHALLENGES AND PROBLEMS WHITE-COLLAR CRIME PRESENTS TO THE CRIMINAL JUSTICE SYSTEM. STRATEGIES TO CONTROL WHITE-COLLAR CRIME WERE NOTED AS COMPETING FOR LIMITED RESOURCES IN A SYSTEM THAT CURRENTLY HAS DIFFICULTY CONTROLLING STREET CRIME. THE SPECIALIZED REQUIREMENTS OF WHITE-COLLAR CRIME CONTAINMENT WERE VIEWED AS COMPLICATING THE SYSTEM'S EFFORTS AT PREVENTING, DETECTING, INVESTIGATING, AND PROSECUTING WHITE-COLLAR CRIME CONTAINMENT. THE THIRD CONFERENCE SESSION RESPONDED TO A PAPER ON THE DEVELOPMENT OF A STRATEGY TO CONTAIN WHITE-COLLAR CRIME. TRADE-OFFS AND THE WIDE RANGE OF POLICY ALTERNATIVES THAT MUST BE CONSIDERED. THE CONFERENCE ALSO DISCUSSED IMPLICATIONS OF THE CRIMINAL JUSTICE SYSTEM ASSUMING EXCLUSIVE RESPONSIBILITY FOR WHITE-COLLAR CRIME CONTROL. THE APPENDIXES CONTAIN A LIST OF SYMPOSIUM PARTICIPANTS, SESSION RATIONALES AND DISCUSSION QUESTIONS, AND THE THREE PAPERS UPON WHICH CONFERENCE DISCUSSION WERE BASED. (AUTHOR ABSTRACT MODIFIED---RCB)
