This report provides an overview of developments in various aspects of criminal law in European countries.
Abstract
This overview is intended to be used in conjunction with the main work from which it is taken, "Developments in Criminal Law in Europe 1989-1992 -- Observations and Trends" (Huber and Restle, 1993/94). The survey from which the information was obtained was conducted between 1989 and 1993. The areas of law reviewed pertain to traffic law; drug laws; environmental law; juvenile law; health, medicine, and pharmaceutical law; juvenile law; animal protection; military criminal law; immigration law; and sentencing law. The review of sentencing law encompasses the death penalty, life imprisonment, penalties for property crimes, labor-related penalties, suspended sentence and parole, and special sanctions against legal persons and company managers. Other sanctions briefly mentioned include the prohibition against using checks in France, the prohibition of entering into an agreement with the public authorities in Italy, the punishment of employers by confiscating goods that have been produced by illegal work in France, England's curfew, and weekend detention as an alternative sanction for juveniles in Spain. The report concludes with an overview of the sentencing process. 205 footnotes
