JUDICIAL DECISIONS SHOW THAT MOST COURTS ARE HESITANT TO GRANT DEFENDANTS' APPEALS FOR EXPUNGEMENT OF ARREST RECORDS UNLESS THERE EXISTS ENABLING LEGISLATION.
Abstract

MOST OF THE CITED DECISIONS HOLD THAT FINGERPRINTING (ON ARREST RECORDS) IS A BURDEN WHICH A CITIZEN MAY HAVE TO ENDURE FOR THE GOOD OF THE COMMUNITY. CONSEQUENTLY, THE MAINTENANCE OF ARREST RECORDS BY THE POLICE WAS PERMITTED. OTHER DECISIONS ARE REPORTED IN WHICH EXPUNGEMENT WAS ORDERED.
