CONSIDERATION OF SEVERAL METHODS TO REDUCE DELAY IN APPELLATE COURT DECISION-MAKING AND TO IMPROVE EFFICIENCY WITHOUT AFFECTING DECISIONAL QUALITY.
Abstract
THE FOLLOWING ASPECTS OF DIFFERENTIATED CASE MANAGEMENT ARE ADVANCED AS POSSIBLE REMEDIES FOR DELAY AND INEFFICIENCY - THE ELIMINATION OF REPORTERS' TRANSCRIPTS IN CASES WHERE FACTS ARE NOT IN DISPUTE, THE USE OF PARTIAL TRANSCRIPTS, THE REDUCTION OF BRIEFING TIME WHEN A LEGAL ISSUE HAS BEEN ADEQUATELY BRIEFED IN TRIAL COURT, THE FILING OF SIMULTANEOUS BRIEFS WHEN EACH PARTY IS AWARE OF THE OTHER'S ARGUMENTS, ELIMINATION OR REDUCTION OF ORAL ARGUMENT IN APPROPRIATE CASES, AND DECISIONS BY ORAL PRONOUNCEMENT OR INFORMAL MEMORANDUM UNLESS A CASE IS SIGNIFICANT.
