This book discusses both current law and earlier legislation regarding disclosure in criminal proceedings in the United Kingdom.
Abstract
On April 1, 1997 the disclosure provisions of the Criminal Procedure and Investigations Act 1996 came into force. These provisions introduced a two-stage system of prosecution disclosure, defense disclosure and a code of practice dealing with the conduct of criminal investigations. The book describes application of the new law and explains the old system, under which all cases started before April 1, 1997 will still be tried. Contents include: (1) general duties of the prosecution; (2) miscarriages of justice caused by disclosure irregularities; (3) disclosure of the prosecution case; (4) disclosure of matters affecting character and credibility of prosecution witnesses; (5) key disclosure issues; (6) privilege, confidentiality and statutory provision preventing disclosure; (7) remedies for disclosure irregularities; (8) proposals for reform of the common law disclosure rules; (9) Criminal Procedure and Investigations Act 1996; and (10) the Disclosure Code of Practice.
