The materials in this kit discuss and display efforts to meld alternative-dispute-resolution (ADR) developments into law firms.
Abstract
ADR, as understood in this kit, refers to procedural applications of the adjudicatory process, the settlement process, and the participatory process. Papers on ADR advantages encompass mediation law and emerging options in dispute resolution. Four papers discuss attorneys' provision of ADR guidance to clients. This includes a sample agreement for consulting a lawyer in a private mediation and the advantages for lawyers in using ADR in resolving commercial disputes. Five papers address the implementation of ADR in law firms. Topics covered in this section include an approach to integrating ADR into law firm practice, a view of ADR's future in law firms, and ADR contract clauses. Three papers consider ADR in various legal situations, including the application of mediation strategies in the traditional practice of family law. Concluding articles examine when ADR may not be appropriate and provide guidelines for lawyers in the use of ADR. Appended ADR case examples, sample ADR law, and a list of law firms using ADR.
