This report discusses six areas identified by Delaware's Domestic Violence Task Force as having the highest priority: mandatory reporting, warrantless arrest, police training and intervention, the courts, accompaniment, and public education.
Abstract
Following a review of Delaware's prior efforts to respond to victims of family violence, the report describes problems in the six areas and makes corrective recommendations. In summary, the task force recommends developing an adequate definition of domestic violence and implementing mandatory reporting. Legislation permitting warrantless arrest in cases of domestic violence should be enacted. Police officers need training in handling volatile family situations. The task force also suggests undertaking a study to clarify the roles of the courts and law enforcement agencies with regard to domestic violence and to develop uniform guidelines for action. Some police officers accompany an abused family member to the home to collect personal belongings, while other police departments are not always able to spare an officer. Guidelines are needed along with further study on the possibility of making accompaniment mandatory. Finally, funding must be secured to help educate the general public about domestic violence. Other areas needing attention include gaps in services and increased emphasis on sanctions and services for the abuser. The appendixes provide a comprehensive list of domestic violence issues, proposed legislation, and a list of task force participants.
