This Information Memorandum delineates the major offenses and associated penalties under Wisconsin's Controlled Substances Act and related provisions.
Abstract
The Memorandum describes current prohibitions pertinent to the manufacture, distribution, delivery, possession with intent to deliver, and possession of controlled substances. It outlines controlled substances violations and sanctions applicable to children, as well as provisions for asset seizure and forfeiture for controlled substances violations. Provisions of the law also cover offenses and penalties that relate to the possession, sale, or use of drug paraphernalia, including separate drug paraphernalia sanctions applicable to children. Other miscellaneous offenses and sanctions under the Controlled Substances Act are reviewed as well. An appendix explains the changes in penalties for felonies (crimes punishable by incarceration in a State prison) in the Controlled Substances Act that will be applicable to such felonies committed on or after December 31, 1999. These penalty increases, which generally involve increasing maximum possible prison sentences by 50 percent or 1 year (whichever is greater), are part of 1997 Wisconsin Act 283, the so-called "Truth in Sentencing Act." This Memorandum includes relevant laws enacted through the 1997-98 legislative session and replaces Information Memorandum 96-17 of the same title, dated July 12, 1996.
