This report of the President's Commission on Model State Drug Laws presents six model State laws designed to disrupt the economic forces that drive the drug trade.
Abstract
The Commission Forfeiture Reform Act provides for effective forfeiture of money and property gained from and used in drug offenses, while ensuring that government officials' use of forfeiture is not abusive or unfair to third parties. Provisions of the Model Demand Reduction Assessment Act impose a fee on individuals convicted of offenses that involve controlled substances, precursor chemicals, and driving under the influence of alcohol. Fees collected are spent on drug education, prevention, and treatment programs. Under the Model Money Laundering Act, the flow of money and property in illegal drug enterprises is made more difficult. This act provides for both criminal and civil remedies that mesh with the Commission Forfeiture Reform Act, the Model Ongoing Criminal Conduct Act, and the Model Financial Transaction Reporting Act. The Model Financial Transaction Reporting Act ensures that State and local authorities have comprehensive access to financial transaction reports obtained under Federal law. Provisions of the Model Money Transmitter Licensing and Regulation Act limit entry into the money transmitter field to qualified persons and sound businesses, provide for the regulation of businesses in the field, and allow revocation of business licenses for conduct tolerant of money laundering or dangerous to consumer funds. The Model Ongoing Criminal Conduct Act helps prevent and remedy the use of money obtained in illegal enterprises to establish and operate legitimate businesses.
