RESEARCH ON RECIDIVISM ON A SAMPLE OF PERSONS SENTENCED TO RESTRICTED LIBERTY IN 1970.
Abstract
RESULTS INDICATE THAT PERSONS SENTENCED TO RESTRICTED LIBERTY HAVE LOWER RATES OF RECIDIVISM THAN THOSE SENTENCED TO IMPRISONMENT. IN FACT, RECIDIVISM RATES FOR PERSONS SENTENCED TO RESTRICTED LIBERTY WERE ALMOST AS LOW AS THOSE OF PERSONS GIVEN PUNISHMENT SUCH AS FINES, WHICH DOES NOT INVOLVE LOSS OF LIBERTY. THE EFFECTIVENESS OF THIS FORM OF PUNISHMENT WAS FOUND TO BE GREATER IF THE OFFENDER HAS AN OCCUPATION OR STABLE SOURCE OF INCOME. THE MOST EFFECTIVE FORM OF RESTRICTION OF LIBERTY WAS TO DEDUCT A SPECIFIED SUM OF MONEY FROM THE OFFENDER'S SALARY, WHILE THE LEAST EFFECTIVE WAS FORCED LABOR. THE EFFECTIVENESS OF THE PENALTY OF RESTRICTED LIBERTY APPEARED TO BE GREATER WHEN LEFT TO THE DISCRETION OF THE COURT THAN WHEN FORMALLY PRESCRIBED BY LAW.
