TITLE III OF THE FEDERAL OMNIBUS CRIME CONTROL AND SAFE STREETS ACT OF 1968 REPRESENTS A COMPROMISE BETWEEN LAW ENFORCEMENT'S NEED TO KNOW AND THE PRIVATE CITIZEN'S DESIRE TO BE LEFT ALONE.
Abstract
THIS ARTICLE OUTLINES SOME OF THE EXACTING DEMANDS MADE BY TITLE III FOR THOSE LAW ENFORCEMENT OFFICERS WHO SEEK THE COURT'S PERMISSION TO MAKE USE OF THE EXTRAORDINARY INVESTIGATIVE DEVICE OF ELECTRONIC SURVEILLANCE. CONSIDERED ARE THE INFORMATION REQUIREMENTS THAT MUST BE MET BEFORE A COURT MAY GIVE PERMISSION FOR AN ELECTRONIC SURVEILLANCE, AUTHORIZATION REQUIREMENTS, PENALTIES FOR DEFECTS IN TITLE III APPLICATIONS AND ORDERS, AND THE ADMISSIBILITY OF PRIVATE, ORAL COMMUNICATION THAT HAS BEEN UNLAWFULLY INTERCEPTED. IN ADDITION, PERTINENT CASES DECIDED BY THE U.S. SUPREME COURT ARE PRESENTED TO ILLUSTRATE THE CONSEQUENCES FOR FAILURE TO FOLLOW THESE REQUIREMENTS....ELW
