POLICE TRAINING FILM WHICH DEPICTS AND DEFINES THE 'EXCEPTIONAL CIRCUMSTANCES' WHICH JUSTIFY A WARRANTLESS SEARCH BY A POLICE OFFICER.
Abstract
A TOTAL OF NINE DRAMATIZED VIGNETTES, BASED ON ACTUAL OCCURRENCES, PRESENT THE DIFFERENT CIRCUMSTANCES UNDER WHICH WARRANTLESS POLICE SEARCHES WERE CONDUCTED. THE EMERGENCY CIRCUMSTANCES EXCEPTIONS TO THE WARRANT REQUIREMENT EXAMINED IN PART 1 INCLUDE THREATS TO HEALTH OR LIFE AND THREATS TO PROPERTY. ALSO CONSIDERED ARE SEARCHES OF AN UNOCCUPIED AUTOMOBILE AND WARRANTLESS POLICE SEARCHES AFTER AN EMERGENCY SITUATION HAS CEASED TO EXIST. PART 2 CONSIDERS SITUATIONS INVOLVING EMERGENCY HOT PURSUIT OF A FLEEING FELON AND EXCEPTIONAL CIRCUMSTANCES PRESENTED BY BOMB AND HOMICIDE INVESTIGATIONS. FOLLOWING EACH SEARCH SITUATION, MOTIONS TO SUPPRESS EVIDENCE OBTAINED AS A RESULT OF THE SEARCH ARE HEARD IN A COURTROOM SETTING.
