Abstract
THIS COLLECTION OF LECTURES PROVIDES A SURVEY OF THE CRIMINAL JURISPRUDENCE IN ENGLAND AND WALES. BASED UPON EDITED TRANSCRIPTS OF LECTURES BY LEADING ENGLISH BARRISTERS, SOLICITORS, AND OTHER CRIMINAL LAW SPECIALISTS, THE FOLLOWING AREAS ARE COVERED: EVOLUTION AND RESPONSIBILITIES OF THE LEGAL PROFESSION; ARREST PROCEDURES AND THE RIGHTS OF THE ACCUSED; MECHANICS OF PROSECUTION; APPELLATE PROCEDURES; PROBATION AND PAROLE SERVICES; NARCOTICS TREATMENTS, AND THE ROLE OF THE PRESS IN CRIMINAL JUSTICE. THESE LECTURES WERE GIVEN BEFORE 231 AMERICAN LAWYERS AND JUDGES WHO WERE ATTENDING AN AMERICAN BAR ASSOCIATION SECTION ON CRIMINAL JUSTICE SEMINAR IN LONDON IN OCTOBER 1976. THE SECOND PART OF THIS BOOK IS A COMPARATIVE ANALYSIS OF ENGLISH AND AMERICAN CRIMINAL LAW, IT PROVIDES A POINT-BY-POINT TREATMENT OF AREAS OF DIVERGENCE IN ANGLO-AMERICAN CRIMINAL JURISPRUDENCE. THE SPECIFIC AREAS DISCUSSED ARE COURTS, THE LEGAL PROFESSION, POLICE ORGANIZATION AND POWERS, RIGHTS OF THE ACCUSED, AND CRIMES. THIS ANALYSIS PROVIDES A KEEN INSIGHT INTO THE EVOLUTION OF THE COMMON LAW IN DIFFERENT MILIEU, RESPONDING TO DIFFERENT NEED AND PERCEPTIONS FROM A COMMON BEGINNING POINT. FOOTNOTES AND INDEXES ARE PROVIDED. (AUTHOR ABSTRACT MODIFIED--BAC)
