DIVISIONS OF ENGLISH LAW, CRIMINAL AND CIVIL PROCEEDINGS, SPECIAL COURTS, LEGAL COSTS AND LEGAL AID, AND THE LEGAL PROFESSION ARE REVIEWED.
Abstract
DISCUSSION OF THE ENGLISH LEGAL SYSTEM IS BROKEN DOWN INTO CASE LAW AND STATUTES, CRIMINAL AND CIVIL LAW, AND EQUITY JURISDICTION PRINCIPLES. A HISTORY OF SUBSTANTIVE LAW COVERS PRE-CONQUEST LAW, CRIMINAL LAW, AND CIVIL LAW AND TRACES SUCH SOURCES OF LAW AS PRECEDENTS, ACTUAL LEGISLATION, CUSTOM, AND MEMBERSHIP IN THE EUROPEAN ECONOMIC COMMUNITY. AN OUTLINE LOOKS AT THE HISTORY OF COURTS AND SUCH CRIMINAL PROCEDURES AS INDICTMENT, SUMMARIES, AND INQUESTS. EXAMINATION OF CIVIL PROCEDURES IN THE HIGH COURT (QUEEN'S BENCH DIVISION) FOCUSES ON PRETRIAL PROCEDURES, CIVIL TRIALS, DAMAGES, JUDGMENTS, AND INSOLVENCY. OTHER CIVIL PROCEEDINGS DISCUSSION RELATES TO THE CHANCERY DIVISION, PROBATE AND ADMINISTRATION, THE COURT OF PROTECTION, THE RESTRICTIVE PRACTICES COURT, MATRIMONIAL MATTERS, AND PROCEEDINGS IN COUNTY COURTS. CIVIL APPEALS AS MADE TO THE COURT OF APPEAL'S CIVIL DIVISION AND TO THE HOUSE OF LORDS ARE EXPLORED. SPECIAL COURTS THAT DEAL WITH ARBITRATION AND INCLUDE ADMINISTRATIVE TRIBUNALS AND MILITARY COURTS ARE REVIEWED. FINALLY, LEGAL COSTS AND LEGAL AID IN CRIMINAL AND CIVIL CASES ARE DETAILED, ALONG WITH ASPECTS OF THE LEGAL PROFESSION ITSELF AND OF THE LAW OF EVIDENCE. AN INDEX, A TABLE OF CASES, AND A TABLE OF STATUTES ARE PROVIDED. (DEP)
