This work includes papers on environmental protection from the standpoint of criminal law.
Abstract
The first paper discusses the environment as a value and environmental protection through criminal law, with emphasis on the need for sufficient justification for interfering with the environment, international environmental law, criminal law and the environment, strategies for using criminal law to protect the environment, and environmental legislation in Italy. The second paper reflects on the penal responsibility of corporate organizations to protect the environment, while the third paper considers environmental protection at national and international levels and the potential and limits of the criminal justice system in dealing with environmental offenses. The third paper includes case studies on transboundary pollution, maritime pollution, environmental damage due to poor management of risks by large industrial plants, and polluting behaviors associated with daily activities of small businesses. Annexes provide additional information on environmental protection through criminal law and problems of criminal responsibility and sanctions regarding environmental violations. Footnotes
