This is the agenda for attendees at the US Department of Justice Advanced Environmental Crimes Conference held in Buffalo, NY, in July 1993. It is a course manual for prosecution of environmental crimes.
Abstract
The agenda was designed specifically for the more experienced environmental prosecutor. Segments of the program are devoted to the following topics, among others: (1) overview of recent changes in environmental criminal law and reported decisions in environmental crimes cases; (2) the effect of failure to comply with the Paperwork Reduction Act on environmental criminal cases; (3) RCRA (Resource Conservation and Recovery Act) update, including defenses raised in past RCRA prosecutions, recycling regulations; (4) Native American lands and who has jurisdiction over them; (5) Public Land laws, including applicability of Title 18 provisions; (6) Federal facilities' compliance; (7) special water issues; (8) sewer discharge and treatment plants; (9) asbestos cases; (10) the complex paper trail; (11) corporate investigations; (12) discovery/FOIA (Freedom of Information Act)/parallel proceedings; (13) bankruptcy; (14) discovery and other issues unique to criminal prosecution of regulatory offenses; (15) science for lawyers; (16) corporate financial data; (17) tax consequences of fines, etc.; (18) Miscellaneous Receipts Act; and (19) The Defense Perspective.
